The City's Policy

The City of Riverbank does not discriminate on the basis of disability in the admissions or access to its programs or activities. An ADA Coordinator has been designated to coordinate compliance with the non-discrimination requirements contained in the Department of Justice regulations implementing Subtitle A of Title II of the Americans with Disabilities Act (42 U.S.C. 12131), which prohibits discrimination on the basis on disability by public agencies.

 ADA Transition Plan

The Transition Plan is the result of a detailed evaluation of all City of Riverbank municipal facilities where programs, activities and services are available to the public.  Municipal facilities include City buildings, parks, and public rights-of-way.

Each facility report lists potential barriers, provides information about the relevant state and federal codes, includes a planning level cost estimate to remove the barrier, and indicates a barrier removal priority.  These reports are a snapshot in time of the conditions observed during the evaluation period.

File an ADA Complaint 

Before filing a complaint, contact the ADA Coordinator at (209) 863-7170 to discuss your concerns.  If further action is needed, a formal complaint will need to be filed.

ADA Policy and Complaint Procedure 

If a public entity has 50 or more employees, it is required to:

 • Designate at least one responsible employee to coordinate Americans with Disabilities Act (ADA) compliance; and 

 • Develop and publish grievance procedures to provide fair and prompt resolution of complaints under Title II of the ADA at a local level.

The City has a designated ADA Coordinator for coordinating the efforts of the City to comply with Title II and for investigating any complaints that the City has violated Title II of the ADA. The Coordinator also is responsible for coordinating the efforts of the City to comply with all other applicable state and federal physical and program accessibility requirements.

Grievance Procedure under

The Americans with Disabilities Act


This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act of 1990 ("ADA").  It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the City of Riverbank.  The City of Riverbank's Personnel Policy governs employment-related complaints of disability discrimination. 

The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request. The complaint should be submitted by the grievant and/or his/her designee as soon as possible but no later than 60 calendar days after the alleged violation to:

Within 15 calendar days after receipt of the complaint, ADA Coordinator or designee will meet with the complainant to discuss the complaint and the possible resolutions. Within 15 calendar days of the meeting, ADA Coordinator or designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print, Braille, or audio tape. The response will explain the position of the City of Riverbank and offer options for substantive resolution of the complaint.

 If the response by ADA Coordinator or designee does not satisfactorily resolve the issue, the complainant and/or his/her designee may appeal the decision within 15 calendar days after receipt of the response to the City Manager or designee.

Within 15 calendar days after receipt of the appeal, the City Manager or designee will meet with the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting, the City Manager or designee will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.

 All written complaints received by the ADA Coordinator or designee, appeals to the City Manager or designee, and responses from these two offices will be retained by the City of Riverbank for at least three years.
